Massachusetts DUI Cases

Driving under the influence of alcohol is a common offense, but it is also one that has far-reaching consequences; a conviction can stay on your driving record for years to come, and perhaps forever. There is a reason for that, of course: thousands of people lose their lives to drunk driving-related accidents every year; in 2013, that averaged out to one drunk driving-related death every fifty-three minutes.
All fifty states have established blood alcohol levels at .08 percent, the legal limit for driving under the influence. Those levels are stricter, .04 percent, when it comes to commercial drivers.
The first thing that anyone who is arrested on suspicion of driving while intoxicated is hire a lawyer with experience in DUI cases. Every case is different, of course, but common strategies for defense lawyers to use include challenging probable cause – that is, whether the officer involved had legal cause to stop the vehicle in question – Miranda rights, in which incriminating statements can be suppressed if the defendant was not read his or her rights; and what are called implied consent warnings, when an officer may have failed to advise the suspect of the consequences of refusing to take a breathalyzer or some other test, or gave such a test incorrectly.
